Petalpushing.com owns exclusive rights to the e-negotiation and e-contract technology used on our site. All rights to trade secrets, patents, copyrights, trademarks, service marks, know-how and other proprietary rights of any type under the laws of any governmental authority, domestic or foreign, including rights in and to all applications and registrations relating to the Service are not available for use. Violators will be contacted and appropriate action taken.
Users Responsibility:
Any suspicion of buyer/seller fraud on the Site will not be tolerated and violators will be prosecuted to the fullest extent of the law. Users agree to remain anonymous while visiting the site. Posting contact information such as phone numbers or addresses during negotiations or in the offer is not permitted and can result in terminating or restricting your access to the site.
Buyer's Conduct:
Petalpushing.com is a business to business Venue. By placing an offer on the Site, Buyer has entered into an irrevocable and binding agreement with the Seller to purchase the goods at the stated price, terms and conditions. If the Buyer defaults after the offer is accepted, a 5% fee will be charged to the buyer. It is the Buyer's responsibility to protect against misrepresentation and fraud (caveat emptor) and to understand the risks involved in buying closeout merchandise. Buyers are provided 24 hours to inspect the merchandise and to report to Petalpushing.com the shipment is not "as advertised". "As advertised" means as pictured in the listing colors and size breakdown as promised. If Petalpushingus.com confirms the order was not shipped "as advertised" Buyer will be instructed to ship back the merchandise at his own shipping expense. Failing to contact Petalpushing.com to report a non-acceptable shipment deems the order "Acceptable" and the order/escrow is closed and funds released to the seller. Buyer and seller releases Petalpushing.com responsible or liable for any reason whatsoever after the close of the order/escrow and the release of funds.
International Shipping:
International shipping policies, restrictions and laws vary depending on the country of import and export. Seller assumes full responsibility for clearing customs and providing documentation to ensure delivery to the buyer. Buyers are responsible for paying custom fees, taxes and duties on delivery.
Close of Sale/Escrow:
Buyer authorizes Petalpushing.com to release Funds to the seller at the Close of Escrow. The closing date is 24 hours after acceptable delivery. Cancelled escrows are subject to a 10% cancellation fee.
Escrow Service
Petalpushing.com provides an escrow-like service between the buyer/seller. All funds are paid to Petalpushing.com and dispersed to the seller at the close of the sale/escrow. Escrow is closed 24 hours after delivery. After the sale/escrow closes buyer must contact seller for returns exchanges, refunds and reorders. If you are an eBay reseller and your auction was cancelled after the sale/escrow has closed, DO NOT CONTACT Petalpushing.com.
Indemnification
In the event User has a dispute with another User, User releases Company, directors, officers, employees and agents from claims, demands and damages, whether actual or consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. This release includes any claims brought by any individuals relating to misuse or unauthorized use of data User gives to Company. Users agree to defend, indemnify and hold harmless the Company, its affiliates, directors, officers, employees and agents to the fullest extent lawful against any and all damages (whether direct, consequential or otherwise), claims, liabilities, costs and expenses incurred (including, without limitation, all reasonable fees), as a consequence of any acts by User undertaken in connection with the Company's Site and Services, including without limitation, those arising out of any breach of any User representation or warranty, User's obligations hereunder, any User transaction attempted through the Service, or any dispute between User and any other Users.
Service Fees
Seller agrees to pay Petalpushing.com a flat service fee at the close of the sale. This fee is non-refundable and non-cancellable. The seller fee can be found at the bottom of the listing form.
